Dog Bites

Dog Bites Are a Devastating Way to Sustain an Injury

Most dog bite victims are children, and many of those children carry a phobia of dogs into adulthood. Considering how popular dogs are and how prevalent they are in public spaces, those phobias can negatively affect a victim for life.

Fortunately, California dog bite laws favor the victim. In other states, in order to file a lawsuit the dog must have already bitten at least one other person. In California, the dog owner is immediately liable, even if the dog has never displayed violent behavior before. This opens us up to seek just compensation for a dog bite attack, regardless of the dog’s previous behavior.

At Abogados Campeones, we understand that dog bites are generally traumatizing, painful, and emotional. We promise to provide legal services to dog bite victims in a caring and compassionate way.

Dog Bite Liability

Ultimately, the dog owner is the primary responsible party for dog bites that occur on public property or while the victim was lawfully on private property. Sometimes the dog owner can avoid liability if they can prove that their dog was provoked, but that is often difficult to prove.

Beyond the owner, a person who has taken over custody and caring for a dog may be considered liable for that dog’s behavior. This extends to rescuers, dog-sitters, friends and family of the dog owner. Additionally, some of the liability can fall to a private property owner if the dog bite occurred on their land in the absence of reasonable safety measures being taken. Lastly, in the state of California, minors cannot be held liable for the damages from a dog bite, even if they are the dog’s owner.

Reasonable Compensation

Following a dog bite, the victim is entitled to compensation in the following categories:

  • Cost of the medical expense to treat the bite
  • Loss of income resulting from the injury
  • Loss of earning potential
  • Pain, suffering, and emotional distress
  • Disfigurement or other permanent conditions resulting from the bite
