FAQ
What is a personal injury?
Under the law, personal injury is defined as bodily harm that is the result of an accident that was caused by another’s negligence. Types of accidents include but are not limited to automobile accidents, motorcycle accidents, slip and fall accidents, dog bite accidents, plane accidents, intentional injury accidents, bus accidents or construction accidents. If you are a loved one has been injured in one of these ways, call Abogados Campeones to determine whether you have grounds for a lawsuit.
How do I know if I have a good personal injury case?
In order to have a solid personal injury case, the following criteria should be met:
- You are injured
- The injury was the result of an accident
- Someone else is at fault
- The party at fault has insurance
- If the party at fault does not have insurance, you have insurance
If you are unsure about the details of your case, please call us to discuss it. We are happy to walk you through the process and help you to determine whether or not you have a case.
Can an undocumented immigrant file a personal injury lawsuit?
Yes. In the state of California, immigration status is not considered in determining liability. If you or a loved one has been injured or even killed due to someone else’s negligence, you are entitled to a fair settlement. The California Assembly Bill 2159 states that immigration information may not be sought or used in a personal injury case. Therefore, it is not permissible to threaten deportation in a personal injury case. At Abogados Campeones, we are happy to take your case regardless of your immigration status.
How does Abogados Campeones charge for services?
Abogados Campeones is a contingency fee-based practice, which means you will not owe us any money until you receive your settlement. If you do not win your settlement, we accept no payment from you. This means that there is no risk for you in pursuing your personal injury case. Fees and payment will be handled once we know the amount of your final settlement. We will explain fees and payments clearly when the time comes.
How long will it take to recover damages?
The time it takes to recover your damages is entirely dependent on the details of your case. It can take a few months or a few years. At Abogados Campeones, we are dedicated to getting you your settlement as quickly as possible, but we will work hard for you no matter how long it takes. These things do not happen instantly, but do not be discouraged by the amount of time it takes to receive a settlement. We will get you what you deserve.
How can I be sure if I need an attorney?
Insurance companies are businesses, and may not make decisions that are in your best interest. If you have been injured due to an accident caused by a person or entity, navigating insurance, medical care, and the damages you are entitled to can be stressful and difficult to understand. Having an attorney on your side to help you understand the process and to maximize your damages is a fantastic way to protect and take care of yourself.
What kind of compensation am I entitled to?
Depending on your injury and the parties at fault, you may receive financial compensation for past medical expenses, future medical expenses, pain and suffering, emotional distress, lost wages, property damage, or for any other related expenses. In the event of wrongful death, you may be entitled to compensation for your loved one’s lost earning potential along with compensation for the loss of companionship. If you are unsure about what you are entitled to, call one of our specialists at Abogados Campeones to discuss it.
Why should I not accept my insurance company’s initial offer?
Insurance companies have standard formulas that they use to calculate your compensation. They take you accident circumstances into consideration, but their initial offer is usually insufficient. It may cover your initial medical bills, but rehabilitation, loss of wages, and pain and suffering will be left up to you. By employing a personal injury attorney, you will likely receive a settlement that is much larger than your insurance company’s initial offer.
Will I have to appear in court?
It is unlikely that you will have to go to court. Most personal injury lawsuits can be settled out of court. However, if things escalate and your lawsuit does result in a trial, Abogados Campeones will stay with you every step of the way and guide you through the process. Our goal is to make this as stress-free as possible, even when a case goes to court.
How is liability determined?
Liability can be a difficult concept to understand. At its core, liability means responsibility. Liability must be determined in a personal injury lawsuit, and another party or entity must be at fault. For example, if you are driving on the freeway and another vehicle rear-ends you resulting in whiplash and neck pain, the driver that hit you is liable for damages.
Liability can be difficult to determine, and it will be helpful for you to have an attorney on your side helping to prove your case. For example, in the result of a trucking accident, the trucking company and/or driver may be liable, and if you only work with one insurance company, you may be leaving money on the table.
