Negligence that leads to accidents

A personal accident can happen for several reasons. It can be something as simple as an oversight, perhaps because you were distracted or even due to a negligent action that ends up causing the accident. Depending on the accident, the responsibility falls on different people or entities. This week’s topic will help us understand better what the procedure is when you are faced with a similar problem.

We will start by explaining a concept that, while simple, serves to help you understand if this legal path is the one you need to follow. What is negligence? The word ‘negligence’ means a person’s lack of care, attention, and diligence in what they do, especially in the performance of an obligation.

For example, a car accident that involves more than one person could fall within the realm of negligence. This must be proven, and that is when your lawyer plays a significant role.

When you want to pursue a negligence claim, you have to prove that the person or persons involved were negligent because they had some kind of obligation that they did not fulfill.

Here are some examples of personal accidents and who is liable in each case.

  1. Slip and Fall – The property or business owner has a legal obligation to keep the place safe from danger. It is his responsibility to fix any risky situation as soon as it arises.
  2. Medical Malpractice: The doctor in charge of the procedure must give the necessary care and have another expert doctor as his witness.
  3. Defective Product: When a product causes an accident, the seller or manufacturer has the responsibility to solve the problem.

This information will help you determine if it is necessary to contact an attorney. They are the ones who will define with you in what respect the owner of the property, the manufacturer of the product, or the one who committed the medical negligence is responsible. Each of these cases has a different path.

Finally, to help with your case before contacting them, take the time to think about who could be a key witness to the accident, as these people will help strengthen your case. If you suffered something similar and need help, do not hesitate to contact us. We will help you find the ideal solution for your case.
